About this data
- Final monetary penalties recorded in EPA's RCRAInfo system by EPA and state agencies since 2015, from EPA's ECHO bulk download (opens in a new tab) as of September 27, 2026.
- One row per penalty at each facility. When RCRAInfo records the same penalty twice for one EPA ID, such as on the initial and final order, it appears once. A multi-site settlement is recorded against each site, so it appears once per site, marked "multi-site".
- Violations cited are those recorded at the facility in the 3 years before the penalty. RCRAInfo's public data doesn't tie each violation to a specific penalty. 6,299 of 6,763 penalties have at least one.
- Generator status is the facility's current status, which may differ from its status when fined.
- States record penalties differently. New Jersey records many small ones; others record few. Compare within a state rather than across states.
Frequently asked questions
What the penalty data shows, and how to read it.
How much is a typical RCRA penalty?
Half of the 6,763 penalties since 2015 were $10,000 or less. 456 were $100,000 or more, and 28 topped $1 million. EPA-led cases run higher than state cases: a median of $25,000 versus $8,920.
Do small quantity generators get fined?
Yes. 1,510 penalties went to facilities now listed as small quantity generators (median $8,372) and 1,022 to very small quantity generators (median $7,200). Large quantity generators account for 2,873. See SQG vs. LQG requirements.
What can I search for?
Company names, cities, states, industries, and EPA IDs. You can also search violation terms like "manifest" or "used oil", a citation like "262.34", a year, or an amount like "over $100,000". Typos and common abbreviations are handled.
What is the maximum RCRA civil penalty?
Up to $124,426 per violation, per day, for administrative orders under RCRA §3008(a)(3), and $93,058 under §3008(g). These come from EPA's inflation adjustment of January 8, 2025, still the latest as of September 2026 (40 CFR 19.4). Actual penalties are usually far lower because EPA scales them to the harm, the extent of the violation, and the facility's circumstances.
How does EPA calculate RCRA penalties?
Under EPA's RCRA Civil Penalty Policy, a gravity amount comes from the potential for harm and the extent of deviation from the rule. EPA can add a multi-day component, adjust for good faith, history, or ability to pay, and add the economic benefit the facility gained by not complying.
Where does this data come from?
EPA's ECHO RCRAInfo bulk download, as of September 27, 2026. It includes final monetary penalties recorded since 2015 by EPA and state agencies. When RCRAInfo records one penalty more than once at a facility, such as on both the initial and final order, it appears here once. A multi-site settlement is recorded against each site, so it appears once per site.
Why doesn't a penalty match the press release?
Press releases often combine the civil penalty with cleanup costs, environmental projects, or amounts paid to other agencies. RCRAInfo records the penalty amount the agency entered, and some large federal settlements aren't recorded there with an amount at all.
Which violations lead to penalties most often?
Among penalties with linked violations, the most-cited areas are generator standards, accumulation and labeling, emergency preparedness, universal waste, and manifests and shipping. See the most common RCRA violations and our research on how often violations repeat.
Can individuals be held personally liable?
Yes. RCRA's criminal provisions allow fines and imprisonment for individuals who knowingly treat, store, dispose of, or transport hazardous waste in violation of the law. Civil penalties are usually assessed against the company.
Stay out of this table.
Many of these penalties trace back to routine misses: an expired accumulation clock, a skipped weekly inspection, a manifest nobody followed up on. RCRAReady tracks each one.
